Welcome to SalesGround AI. These Terms and Conditions (“Terms”) govern your access to and use of our platform, including the website builder, CRM system, and integrations with WhatsApp, Facebook, and other services. By using our services, you agree to these Terms. If you do not agree, please do not use the platform.

1. Eligibility

To use SalesGround AI, you must:

  • Be at least 18 years old or legally authorized to represent a business.
  • Provide accurate and complete information when registering.
  • Use the platform in compliance with all applicable local, national, and international laws.
  • Use the platform solely for lawful business purposes and in accordance with third-party platform policies.

We reserve the right to suspend or terminate accounts that violate these Terms.

2. Services Provided

SalesGround AI offers:

  • A website builder for creating and managing business websites.
  • A smart CRM with WhatsApp, Facebook, and other integrations to manage customer communications and orders.
  • Analytical tools to track and enhance customer interactions.

While we aim to provide continuous and reliable service, we do not guarantee uninterrupted access. Notices will be issued for scheduled maintenance or significant disruptions (24-hour notice).

3. User Responsibilities

By using SalesGround AI, you agree to:

  • 3.1 Account Information
    Maintain accurate and up-to-date account and payment details to ensure uninterrupted service and compliance.

  • 3.2 Responsible Use
    Use SalesGround AI responsibly. Do not misuse the platform by engaging in activities such as spamming, sharing prohibited content, or violating any platform terms.

  • 3.3 Account Security
    Protect your login credentials. You are responsible for maintaining the confidentiality of your account information. Notify us immediately of any unauthorized access or security breaches.

  • 3.4 Legal Compliance 
    Use the platform in accordance with all applicable laws, including data protection and privacy regulations.

  • 3.5 Third-Party Policies
    Respect and comply with the terms of service of any integrated third-party platforms, including but not limited to WhatsApp and Facebook.

  • 3.6 Content Responsibility
    You are solely responsible for any content you upload or share through the platform, including your website content and communications with customers.

4. Customer Data and Privacy

When using our CRM and integrations, you act as the data controller and are responsible for:

  • Obtaining proper consent before collecting or using customer data.
  • Ensuring data usage complies with applicable privacy laws.
  • Using customer data strictly for legitimate business purposes.

 SalesGround AI  acts as a data processor, handling data only per your instructions. For more details, refer to our Privacy Policy.

5. Payments and Subscriptions

Some features require a paid subscription. By subscribing, you agree to:

  • Pay all applicable fees as outlined during sign-up or on our website.
  • Provide valid, up-to-date payment information.
  • Allow recurring charges until the subscription is canceled.

All payments are non-refundable unless required by law or outlined in our refund policy. We may suspend services for failed or overdue payments.

6. Intellectual Property

  • SalesGround AI Content: The platform, including design, features, and code, is the intellectual property of  SalesGround AI and may not be copied, modified, or distributed without prior written consent.
  • User Content: You retain ownership of all content you create using the platform. You grant  SalesGround AI  a limited, non-exclusive license to use it solely for service delivery.
  • Feedback: Any feedback or suggestions provided may be used to improve the platform without any obligation to you.

7. Prohibited Activities

You agree not to:

  • Use the platform for illegal purposes.
  • Send spam or share deceptive, harmful, or restricted content.
  • Interfere with platform operations, attempt to gain unauthorized access, or reverse-engineer the system.
  • Collect or process sensitive data (e.g., health, financial) without proper legal basis.

Violation may lead to suspension or termination of your account and potential legal action.

8. Third-Party Integrations

 SalesGround AI  integrates with external services like WhatsApp and Facebook. You are responsible for complying with the respective terms of these services. We are not liable for issues arising from these platforms, including service disruptions or policy violations.

9. Termination

You may cancel your account at any time through the dashboard or by contacting support.

We may suspend or terminate your account if you:

  • Breach these Terms or third-party policies.
  • Fail to make timely payments.
  • Engage in conduct that disrupts our services or harms other users.

Upon termination, your access will be revoked, and data will be deleted per our Privacy Policy, subject to legal obligations.

10. Limitation of Liability

SalesGround AI is provided “as is.” To the extent permitted by law:

  • We are not liable for indirect or consequential damages, including loss of data or business.
  • Our liability is limited to the total fees paid by you in the 12 months preceding a claim.
  • We are not responsible for failures or issues related to third-party services.

11. Indemnification

You agree to indemnify and hold harmless SalesGround AI and its affiliates from claims, liabilities, damages, or expenses arising from your use of the platform, including any violations of these Terms or applicable laws.

12. Changes to Terms

  • 12.1 Updates to Terms
    We may update these Terms periodically. Users will be notified of any material changes at least 30 days in advance, either via email or through a notice on the platform.

  • 12.2 User Right to Terminate
    If you do not agree with the updated Terms, you may terminate your use of SalesGround AI before the changes take effect. Continued use of the platform after the effective date of the changes constitutes your acceptance of the revised Terms.

13. Governing Law and Dispute Resolution

  • 13.1 Governing Law
    These Terms shall be governed by and construed in accordance with the laws of Pakistan, without regard to its conflict of law provisions.

  • 13.2 Good-Faith Negotiations
    Before initiating any formal dispute resolution process, both parties agree to make reasonable efforts to resolve disputes through good-faith negotiations. This negotiation period shall last no fewer than 30 days from the date one party notifies the other in writing of the dispute.

  • 13.3 Jurisdiction
    Any disputes that cannot be resolved through negotiation shall be subject to the exclusive jurisdiction of the courts located in Karachi, Pakistan, unless otherwise required by applicable law.

15. Force Majeure

 SalesGround AI shall not be held liable for any delay or failure in performance resulting from causes beyond its reasonable control, including but not limited to natural disasters, acts of government, war, terrorism, labor disputes, power outages, internet failures, or other unforeseen events ("Force Majeure Events").

16. Severability

 If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable and will not affect the validity and enforceability of the remaining provisions.

17. Entire Agreement

 These Terms, together with our Privacy Policy, constitute the entire agreement between you and SalesGround AI regarding your use of the platform. They supersede all prior or contemporaneous communications, whether oral or written, relating to your use of the services.
